反制錯誤報導武漢肺炎資訊的媒體 馬來西亞政府下令採取「強硬措施」

馬來西亞國家安全法庭指示警方與該國通訊及多媒體部(Ministry of Communications and Multimedia ,簡稱為KKMM),要採取「強硬的措施」,來打擊發佈關於「嚴重特殊傳染性肺炎」(COVID-19,本處使用台灣衛生福利部疾病管制局翻譯,多數華語地區簡稱「武漢肺炎」,中國稱「新冠病毒」)的失真報導的新聞網站。馬來西亞公民社會團體對這項聲明表達了擔憂。數家媒體也批評了政府發佈的一個圖表,這個圖表詳細羅列了所謂「假新聞」的類型,其中包括批評政府的貼文。

2020年4月1日,馬來西亞國防部長依斯邁沙比利(Datuk Seri Ismail Sabri Yaakob)宣佈,KKMM和警方接到指示,要採取強硬措施 [3]來打擊發佈「混淆視聽和失真新聞內容」的新聞網站。他解釋道,向公眾提供關於武漢肺炎的準確訊息非常重要。

多個公民社會團體批評了這項政策,警告 [4]此舉直接地打壓了言論自由。

A disproportionate response by directing punitive actions against media institutions can be counter-productive as it could shut down the flow of information and related public discourse that is crucial in dealing with public health issues.

[馬來西亞政府]下令使用不合比例原則的懲罰性措施來對付媒體,最終可能會弄巧成拙。這種小題大做的方法,可能會切斷資訊與相關輿論等有助於解決公共衛生問題的關鍵訊息的傳播。

他們也質問為何部長的聲明中僅針對新聞網站,並且補充說道,讓政府來決定媒體報導的內容是否失真,是件很危險的事。

Governments cannot be the sole arbiters of truth by having the power to arbitrarily decide what information can and cannot be in the public domain and what has been “misquoted” or “misreported.”

政府不應該專斷地決定哪些訊息可以讓公眾知曉,哪些信息又是被錯誤地引用或者是假新聞,從而成為訊息真實性的唯一裁判者。

國際人權組織「第十九條 [5]」(Article 19)馬來西亞分部即敦促政府,當國家在對抗武漢肺炎時,要保護媒體的工作。

The gov will lose their credibility when they start attacking media& journalists.The gov must make efforts to protect the work of journalists. Journalists&media are front liners that work hard to provide info to the public and their work must be protected instead of undermined.

在公共衛生危機期間,一個獨立、自由、安全的媒體是不可或缺的。媒體和記者在向民眾傳遞資訊方面有非常重要的作用,有助於提升向公眾傳播政府的政策和公共衛生建議時的效率和訊息準確性。

當政府開始攻擊媒體和記者時,這個政府就會失去公信力。政府必須採取措施來保障記者的工作。記者和媒體處在前線為民眾提供消息,他們的工作必須得到保護,而不是受到打壓。

假新聞類型圖表

4月10日,馬來西亞新聞局(Jabatan Penerangan Malaysia)發佈了一張資訊圖表 [7],告知大眾哪些訊息是假新聞。下列幾種內容會被認定為假新聞(由獨立新聞中心〈Centre for Independent Journalism,簡稱CIJ〉翻譯):

[content that] brings down the dignity and image of an individual, the reputation of an organisation and the country; instills hate towards the ruling government and leaders; relates to the infrastructure of critical information about the country; involves teachings of extremist beliefs; touches on the sensitivity of religion and race; and contains elements of pornography, gambling and lies.

抹黑個人的尊嚴、形象、組織和國家名譽;煽動對政府和領導者的不滿;和國家重要資訊相關的基礎設施;教唆極端信仰;觸及關於地區和宗教的敏感問題;包含色情、賭博和詐騙等元素。

獨立新聞中心指出,這份由該國新聞局發佈的內容明細,可能會導致對於言論自由的迫害 [8]

The dangers of generalising and listing the alleged ‘types’ of ‘fake news’ alludes to tactical attempts by the government at cracking down legitimate speech aimed at crushing dissent or differences of opinion or disproportionately restricting various forms of expression.

這件事的危險性在於:歸納和列出所謂「假新聞」的「類型」,暗示著政府正在進行打擊合法言論的策略性嘗試,以期摧毀異議和歧見,或過當地限縮不同形式的表意自由。

馬來西亞老牌人權組織「國民警醒運動」(Aliran)表示,這件事反映 [9]了政府的不安全感:

We take issue especially with the government’s attempt to punish those whose criticisms are deemed to have caused ‘distrust in the ruling government’.

Resorting to censorship, especially in its extreme form, in a time of crisis reflects the insecurity of the government of the day.

我們尤其關注政府在懲罰批評意見的企圖,因為他們認為這些批評造成了「對當局的不信任」。

實行極其嚴厲的審查制度,顯示出了政府在這個危機時刻的不安。

馬來西亞國會議員法米‧法德濟(Fahmi Fadzil)也對政府部門提出了質問。他在臉書 [10]上寫道:

Is the government saying we can no longer comment or be enraged when a minister says warm water can help kill the Covid-19 virus?

Or if when there are graphics released by the government that invites wives to address their husbands while mimicking the voice of Doraemon?

When it’s right, it’s right. When it’s wrong, it needs to be corrected.

政府的意思是不是,當一名部長說溫水能夠殺死病毒時,我們不能評論或表示不滿?

或者當政府發佈了一份圖解,建議妻子們透過模仿哆啦A夢的聲音來教育他們的丈夫?

對的就是對的,不對就得改正。

這名議員指涉 [11]的,是最近一位部長宣稱喝溫水可以殺死這個病毒,還有一則建議家庭主婦們模仿哆啦A夢的聲音來防止家庭暴力的政府資訊。

獨立新聞中心已經起草 [12]了一篇詳盡的宣言,說明如何在武漢肺炎大流行時,保障言論自由,對抗誤導視聽的內容:

Have efficient/broad channels of information from the govt and media for the public to verify info and report misinformation

Repeal/amend laws that arbitrarily stifle speech!

6.「假新聞」-識讀教育的成果往往剩餘直接法律制裁。異議是必須被傾聽的;如此才有辦法促進民主。

政府和媒體應該設計多種訊息渠道,用來驗證和回報假訊息。

廢除和修改任意扼殺言論自由的法律!
